Terms and Conditions of Use

Welcome to FG Tackle.co.za (“the Website”), an e-commerce platform operated by FG Tackle (Pty) Ltd, a company registered in the Republic of South Africa with registration number 2024/523655/07, located at 64 Fabriek Street, Gants Centre, Strand,7140, South Africa. By accessing or using our Website at www.fgtackle.co.za, you (“the User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use our Website. 

These Terms govern the use of the Website, the purchase of fishing tackle and related products, and the relationship between you and the Provider. Additional policies, such as our Privacy Policy and Returns Policy, are incorporated by reference and form part of these Terms.

1.1 Purpose: The Website is an e-commerce platform specializing in the sale of fishing tackle, including rods, reels, lures, lines, and accessories, to consumers and businesses in South Africa.

1.2 Eligibility: By using the Website, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding contract. If you are using the Website on behalf of a business, you warrant that you have the authority to bind that business.

1.3 Changes to Terms: We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Website. Continued use of the Website after changes constitutes acceptance of the revised Terms.

1.4 Governing Law: These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or use of the Website will be subject to the jurisdiction of the Somerset West Magistrate’s Court or High Court, as applicable.

2.1 Access: You may browse the Website, make purchases, or access content subject to these Terms. You may not use the Website for unlawful purposes, including but not limited to fraud, hacking, or distributing malicious code.

2.2 Prohibited Uses: You agree not to:

3. Product Purchases

3.1 Product Descriptions: We strive to ensure that product descriptions, images, and prices are accurate. However, errors may occur, and we reserve the right to correct them. If a product is mispriced, we may cancel the order and issue a full refund.

3.2 Availability: All products are subject to stock availability. If a product is unavailable, we will notify you and issue a full refund within 30 days or offer an alternative product.

3.3 Pricing: All prices are in South African Rand (ZAR) and include VAT where applicable. Prices exclude shipping costs, which are displayed at checkout. Prices are subject to change without notice.

3.4 Payment Methods: We accept payments via credit/debit cards (Visa, MasterCard), EFT, and [other methods, e.g., PayFast]. Card payments are processed through a secure payment gateway ([e.g., PayFast]) using 256-bit SSL encryption. We do not store credit card details.

3.5 Order Confirmation: Orders are confirmed upon receipt of payment. You will receive an email confirmation with order details. Orders are subject to acceptance by the Provider.

3.6 Cancellation by User: You may cancel an order before it is dispatched by contacting us at info@fgtackle.co.za. A 10% administration fee may apply. Once dispatched, cancellations are subject to our Returns Policy.

3.7 Cancellation by Provider: We reserve the right to cancel an order if stock is unavailable, payment fails, or the product does not meet our quality standards. In such cases, you will receive a full refund without deductions.

6. Consumer Rights

6.1 Cooling-Off Period: Under Section 44 of the ECTA, you may cancel an online purchase within 7 days of receiving the product without reason, provided you notify us in writing and return the product in its original condition. You are responsible for return shipping costs, and a refund will be issued within 30 days of receipt.

6.2 Transparent Pricing: All prices, including additional costs (e.g., shipping, taxes), are clearly displayed before checkout, as required by Section 43 of the ECTA.

6.3 Complaints: Any complaints about products or services should be directed to info@fgtackle.co.za. We aim to resolve issues within 14 days. You may escalate unresolved disputes to the Consumer Goods and Services Ombud (www.cgso.org.za).

7. Privacy and Security

7.1 Personal Information: We collect personal information (e.g., name, address, payment details) to process orders and improve services. Our Privacy Policy, available at www.fgtackle.co.za/POPIA, explains how we collect, use, and protect your data in compliance with POPIA.

7.2 Security: Payment transactions are processed through a secure payment gateway with 256-bit SSL encryption. We do not store credit card details. Our Website uses reasonable security measures to protect your data, but you use the Website at your own risk.
